The High Court has issued a conservatory order restarining the Government through its various agencies from implementing the proposed tolling of various Highways constructed using public funds.
Justice Chacha Mwita of the High Court’s Constitutional and Human Rights division issued the order following a petition filed in the Court by the Consumer Federation of Kenya (COFEK). The Judge further directed that the leadings be served on all parties and gave timelines for the parties to respond. The case shall be mentioned on 8th October, 2024 for the Court to issue directions on how it will proceed.
This comes amidst a statement recently issued by the Kenya National Highway Authority (KeNHA) which statement hinted that the Authority was in the process of developing a Road Tolling Policy. Through its X page, KENHA had stated that the Policy would be developed with extensive public participation to ensure that all voices are heard. Some of the roads under consideration for the tolling include: the Nairobi Southern Bypass, Nairobi-Nakuru-Mau Summit Highway, Thika Superhighway, Kenol-Sagana-Marua Road, Mombasa Southern Bypass, Dongo Kundu Bypass, among others.
Toll Fees Payment in Kenya
Presently, motorists in Kenya pay toll fees on only one road that is; Nairobi Express Way, which was constructed under a Public-Private Partnership (PPP), where the private entity is to collect the fees for a period of about 25 years to recoup its investment before handing it over to the Government of Kenya.
